Planning Applications Committee

Purpose of committee

Terms of reference

 

To exercise the functions, powers and duties of the Council in relation to planning and development control matters.

 

To hear pre-application presentations by developers on strategic development schemes and for individual members of the committee to ask questions and highlight issues that may require further consideration by the developer.

 

Applications to be determined by the Planning Applications Committee:

(1)    Applications, other than applications made under S73 or 96A of the Town & Country Planning Act 1990), which are recommended for approval where the application falls within one of the following:

a.         the provision of dwelling houses where:

                         i.         the number of dwelling houses to be provided is 10 or more; or,

                        ii.        the development is to be carried out on a site having an area of 0.5 hectare or more;

b.         the provision of a building or buildings where the floor space to be created including changes of use, by the development is 1,000 square metres or more; or,

c.         development carried out on a site having an area of 1 hectare or more.

 

1(A) For applications falling to be considered prior to 7th May 2021:

Applications, other than applications made under S73 or 96A of the Town & Country Planning Act 1990), which are recommended for approval where the application falls within one of the following:

a.         the provision of dwelling houses where:

i.        the number of dwelling houses to be provided is between 10 and up to and including 35 ; or,

ii.       the provision of a building or buildings where the floor space to be created including changes of use, by the development is between 1,000 square metres and up to and including 3,500 square metres; or,

b.       change of use to Class A5 (Hot Food Takeaways), as set out in the Town and Country Planning (Use Classes) Order 1987; and,

c.       a proposal which is a significant departure from the policies of the Council's Development Plan;

 

but only when a written request is made by a member of the committee or ward member, and where such request is agreed by the Chair of the committee (in consultation with the Strategic Director Growth & Opportunity or the Director - Planning, Transport and Sustainability or Assistant Director – Development Management and Enforcement) that there is a material planning reason for doing so.

 

(2)       Applications which are recommended for approval where an objection to the current proposal has been received which is based on material planning grounds, other than those applications where, in the opinion of the Head of Development Management or the Director - Planning, Transport and Sustainability or the Assistant Director – Development Management and Enforcement:

a.      the objection can be overcome by the imposition of an appropriate condition; and/or,

b.      where the application clearly complies with the relevant planning policies in which case the decision may be taken by officers.

 

(3)       Applications which the Strategic Director Growth & Opportunity, Director - Planning, Transport and Sustainability or the Assistant Director – Development Management and Enforcement wishes to refer to the committee.

 

(4)       Any application where a specific written request is made by any member of the Council for the case to be reported to the Committee, where in the opinion of the Chair (in consultation with the Head of Development management) there is a material planning reason for doing so.

 

(5)       Applications made by the Council for development of land in its ownership in respect of which the Council proposes to grant to a third party any form of right or interest.

 

(6)       Applications which have been submitted by or on behalf of a Member of the Council (or by anyone listed in section 2.3 under Officers’ Code of Conduct) or by a member of the Council’s staff (or by anyone listed in section 2.3 under Officers’ Code of Conduct).

 

(7)       Applications for the total or substantial demolition of a listed building.

 

(8)       Applications recommended for approval where it is proposed to grant permission for a change of use to Class A5 (Hot Food Takeaways), as set out in the Town and Country Planning (Use Classes) Order 1987.

 

(9)       Applications which are recommended for approval where it is proposed to grant permission for a proposal which is a significant departure from the policies of the Council's Development Plan.

 

(10)    To authorise, release or modify agreements and undertakings under Section 106 of the Town & Country Planning Act 1990, Section 16 of the GLC (General Powers) Act 1974, Section 278 of the Highways Act 1980, Section 111 of the Local Government Act 1972 and Section 33 of the Local Government (Miscellaneous Provisions) Act 1982 which in the opinion of the Strategic Director Growth & Opportunity, or the Director - Planning, Transport and Sustainability  relate to developments  falling within any of the categories referred to at paragraphs 1(a), (b) or (c) above, irrespective of the type of any associated planning application, but only when, a written request is made by a member of the Committee or ward member, and where such request is agreed by the Chair of the Committee (in consultation with the Director - Planning, Transport and Sustainability or the Assistant Director – Development Management and Enforcement  that there is a material planning reason for doing so.
