Declaration of Pecuniary Interests

Under Standing Order 4.4, where any councillor has a Disclosable Pecuniary Interest (as defined in the Members’ Code of Conduct (para. 4)) in any matter to be considered at a meeting of the Council, a committee, sub-committee or joint committee, they must withdraw from the meeting room during the whole of the consideration of that matter and must not participate in any vote on that matter unless a dispensation has been obtained from the Monitoring Officer.

RESOLVED:  That the minutes of the previous meeting held on 18 December 2018 and 22 January 2019 be approved and signed by the Chair as a correct record of the proceedings.

 

The Chair announced a provisional timetable for the meeting in accordance with Standing Order 9.9.1.

    Officer’s recommendations:

    1.    Resolve to grant conditional planning permission subject to the completion of an agreement under Section 106 of the Town and Country Planning Act 1990 containing the planning obligations listed in the report.

     

    2.    Agree to delegate authority to the Assistant Director of Planning, Transport and Development to:

     

    a.    Finalise the recommended conditions as set out in this report, addendums and/or PAC minutes; and

    b.    Negotiate, agree and finalise the planning obligations as set out in the report, addendums and/or PAC minutes pursuant to Section 106 of the Town and Country Planning Act 1990 (as amended).

     

    3.    In the event that the committee resolves to refuse planning permission and there is a subsequent appeal, delegated authority is given to the Assistant Director of Planning, Transport and Development, having regard to the heads of terms set out in the report, addendums and/or PAC minutes, to negotiate and complete a document containing obligations pursuant to Section 106 of the Town and Country Planning Act 1990 (as amended) in order to meet the requirement of the Planning Inspector.

     

    4.    In the event that the Section 106 Agreement is not completed within 3 months of the date of the committee meeting, delegated authority is given to the Assistant Director of Planning, Transport and Development to refuse planning permission for failure to enter into a section 106 agreement for the mitigating obligations identified in the report, addendums and/or the PAC minutes.

    Minutes:

    The Planning Officer explained that after publication, officers had been made aware that the application would constitute a departure from Policy ED2 of the Local Plan, and that this had not been advertised during consultation.  Officers were recommending a deferral in order to advertise and consult on this departure from policy.

     

    It was MOVED by Councillor Wilcox, SECONDED by Councillor Masters, and

     

    RESOLVED, unanimously

     

    To defer consideration of the application.

6 Lansdowne Hill (Knight's Hill) 18/00580/FUL pdf icon PDF 1 MB

    1.    Resolve to grant conditional planning permission subject to the completion of an agreement under Section 106 of the Town and Country Planning Act 1990 (as amended) containing the planning obligations listed in the report and any direction as may be received following further referral to the Mayor of London.

     

    2.    Agree to delegate authority to the Assistant Director of Planning, Transport and Development to:

    a.    Finalise the recommended conditions as set out in the report, addendums and/or PAC minutes; and

    b.    Negotiate, agree and finalise the planning obligations as set out in the report, addendums and/or PAC minutes pursuant to Section 106 of the Town and Country Planning Act 1990 (as amended).

    Minutes:

    The Planning Officer explained that some Ward Councillors and Members of the public who had made representations had not been informed of the date of the meeting.  In the interests of fairness and due process, officers were recommending that the Committee defer consideration of this application.

     

    The Chair stated that while all statutory obligations had been adhered to, deferring the application would allow all interested parties to engage with the process if they so wished.

     

    It was MOVED by Councillor Wilcox, SECONDED by Councillor Windle, and

     

    RESOLVED, unanimously

     

    To defer consideration of the application.

     

5.

Streatham and Clapham High School, 42 Abbotswood Road (St Leonards) 18/04221/VOC pdf icon PDF 1 MB

    1.    Resolve to grant conditional planning permission.

     

    2.    Agree to delegate authority to the Assistant Director of Planning, Transport and Development to finalise the recommended conditions as set out in the report, addendums and/or PAC minutes.

    Minutes:

    The Planning Officer explained that following publication of the agenda, officers had been made aware of a number of issues relating to this application.  The wording of the condition in the report would not allow other schools to use the pitch during school hours.  A revised condition would be necessary and would need to be consulted on.  A parking stress survey would also be completed before the application would be considered.

     

    It was MOVED by Councillor Wilcox, SECONDED by Councillor Griffiths, and

     

    RESOLVED, unanimously
