Declaration of Pecuniary Interests

Under Standing Order 4.4, where any councillor has a Disclosable Pecuniary Interest (as defined in the Members’ Code of Conduct (para. 4)) in any matter to be considered at a meeting of the Council, a committee, sub-committee or joint committee, they must withdraw from the meeting room during the whole of the consideration of that matter and must not participate in any vote on that matter unless a dispensation has been obtained from the Monitoring Officer.

RESOLVED: The minutes from the 23 November meeting were agreed as a correct record of proceedings.Chair as a correct record of the proceedings.

The Chair announced a provisional timetable for the meeting in accordance with Standing Order 9.9.1.

    Officer Recommendations:

     

    Application 1: 21/02594/VOC

    1. Resolve to grant planning permission, subject to conditions and completion of a

    planning obligation under Section 106 of the Town and Country Planning Act 1990 in the terms set out in the report and in a form satisfactory to the Local Planning

    Authority.

     

    2. That if the required planning obligation is not completed by 01 July 2022 the Director of Planning, Transport and Sustainability be given delegated authority to refuse the application in the absence of a legal agreement.

     

    3. In the event that the Committee resolves to refuse planning permission and there is a subsequent appeal, delegated authority is given to the Director of Planning, Transport and Sustainability, having regard to the report, to negotiate and accept a planning obligation in order to meet the requirements of the Planning Inspector.

     

    Application 2: 21/02631/REM

    1.    Resolve to approve the reserved matters subject to the conditions recommended in the report.

     

    2.    Agree to delegate authority to the Director of Planning, Transport and Sustainability to finalise the recommended conditions as set out in the report, addendums and/or PAC minutes.

     

    3.     In the event that the Committee resolves to refuse to approve the reserved

    matters and there is a subsequent appeal, delegated authority is given to the

    Director of Planning, Transport and Sustainability to conduct the appeal on

     behalf of the Local Planning Authority including completing any necessary

     documents to meet the requirements of the Planning Inspector.

    Case No. 21/02594/VOC and 21/02631/REM, (agenda item 3, page 21 of the agenda pack, page 11 of the first addendum).

     

    The planning officer stated that there were two applications for this agenda item.  Application 1 proposed the variation of condition 2 of the outline planning permission to allow minor amendments to the original outline permission which was approved in 2019. Application 2 was seeking approval of the Reserved Matters for Phase 2 of the outline permission.   Members were advised to consider Application 1 first. 

     

    The planning officer noted that:

    -       There was a masterplan for the regeneration of the Westbury Estate, and this had three phases. Phase 1 was approved under a separate full planning application. This phase is practically complete.

    -       There were minor amendments to the original outline permission proposed by Application 1.

    -       Officers recommended a minor correction be made to the summary description of the approved matters in the draft decision notice or Application 2 set out in the report at page 56 of the agenda, to refer to the application reference of Application 1, that is the reserved matters submitted relate to planning permission 21/02594/VOC.

    The Committee then heard the following points from supporters:

    -       Homes for Lambeth (HfL) was created by Lambeth Council to create safe and sustainable homes within the borough.

    -       The scheme would provide a better community and improvements to the homes for current secure tenants.

    -       The design of the master plan including deriving materials, design and massing was created in consultation with residents.

     

    Officers provided the following information following Members’ questions:

    -       The daylight and sunlight impact did not change due to the minor nature of the proposed amendments to the agreed parameters of the outline permission

    -       The environmental sustainability performance would be improved due to the change from the combined heat and power (CHP) to air source heat pumps.

    -        The scheme was closer to achieving the zero-carbon target with the approval of these applications.

    -       The size of the 1, 2 and 3-bedroom units was in compliance with the minimum policy requirements.

     

    The Chair then moved to a vote.

     

    21/02594/VOC:

    It was MOVED by Councillor J Simpson, SECONDED by Councillor Dogus

     

    And

     

    RESOLVED, unanimously:

     

    1.   To GRANT planning permission, subject to conditions and completion of a planning obligation under Section 106 of the Town and Country Planning Act 1990 in the terms set out in the report and in a form satisfactory to the Local Planning Authority.

     

    2. That if the required planning obligation is not completed by 01 July 2022 the Director of Planning, Transport and Sustainability be given delegated authority to refuse the application in the absence of a legal agreement.
