Under Standing Order 4.4, where any councillor has a Disclosable Pecuniary Interest (as defined in the Members’ Code of Conduct (para. 4)) in any matter to be considered at a meeting of the Council, a committee, sub-committee or joint committee, they must withdraw from the meeting room during the whole of the consideration of that matter and must not participate in any vote on that matter unless a dispensation has been obtained from the Monitoring Officer.

    Presentation by the Licensing Officer

     

    The Sub-Committee was informed that this was an objection to a Temporary Event Notice (TEN). The Sub-Committee’s attention was drawn to chapters 7, 9 and 15 of the Statutory Guidance and Sections 5, 5.11, 5.20 and 5.27 of the Statement of Licensing Policy as the ones particularly relevant to this application. The options available to the Sub- Committee were set out in paragraph 6.1 of the report on page 8 of the agenda papers. The Licensing Officer confirmed:

     

    The Licensing Officer informed the Sub-Committee that:

     

    ·      This was an objection to a temporary event notice (TEN).

    ·      The notice giver was DNS London limited.

    ·      The TEN was objected to by Public Protection.

    ·      The TEN was for regulated entertainment, late night refreshment and the sale of alcohol.

    ·      The additional hours of licensing activity was sought from 01:30 to 03:00 on Monday 1 July 2019.

    ·      The premises had a licence from 24 Nov 2005.

    ·      DNA, the company holding the licence had held the licence since 3 June 2014.

    ·      The DPS was Mr Nicolo Mascitti who had been the licence holder since 2014.

    ·      There was only one other TEN given regarding the premises. This was on 3 May 2019 between 01:00 and 03:00 for a capacity of 180 persons.

     

    In response to questions from Members, the Licensing Officer informed the Sub-Committee that:

     

    ·      The notice giver was informed of the hearing but had not responded.

     

    Presentation by interested parties

     

    Mr Arif Kokkoz, Public Protection Officer, informed the Sub-Committee that:

     

    ·      Since January 2019, he had received noise complaints from the premises.

    ·      He had received 19 complaints to date concerning the premises from various complainants.

    ·      One 10 April 2019, he served a warning notice to the premises due to an alleged noise nuisance emanating from the premises.

    ·      The event would be held on Sunday night until Monday morning and there would be no Police presence at the premises or Clapham BID officers to observe antisocial behaviour or noise levels.

    ·      Some of the complaints relating to the premises involved parking.

    ·      It was not clear how premises staff would manage crowds or what the security arrangements would be.

    ·      The premises was located in a controlled impact zone and the notice giver wanted 180 patrons to attend the event.

    ·      The premises could only hold 80-100 people.

    ·      There were safety issues relating to the premises.

     

    Mr Danial Vacciana, Public Protection Officer, informed the Sub-Committee that:

     

    ·      The premises previously had a few licensing breaches which he had witnessed.

    ·      The premises was located in Clapham High-Street which was part of the night time economy.

    ·      There were several complaints regarding the premises and many of these were submitted on Sunday nights.

    ·      The event would be held on Sunday night.

    ·      If the Sub-Committee decided to issue a counter notice, then the notice could be hand delivered.

    At this point the proceedings, the Licensing Officer informed the Sub-Committee that there was no maximum capacity figure set on the licence.
